Terms of service

These Terms of Service (“Terms”) govern your use of marcosjacob.com and any order you place with Marcos Jacob, 60 Hudson Street, Suite 1400, New York, NY 10013, United States (“we”, “us”, “our”). By using the site or placing an order, you agree to these Terms. Please read them carefully.

1. Who can use the site

You must be at least 18, or have the consent of a parent or guardian, and be able to form a binding contract, to place an order. By ordering, you confirm the information you give is accurate and that you’re authorised to use the payment method.

2. Orders and acceptance

Placing an order is an offer to buy. A binding contract forms only when we send your dispatch confirmation email — an order confirmation alone does not create a contract. We may decline or cancel an order (for example: stock unavailability, a pricing or description error, suspected fraud, or an address we can’t ship to). If we do, we’ll refund any payment in full, normally within 5 business days.

3. Prices and payment

All prices are in US dollars and are shown at checkout, including any applicable discount, before you pay. Any sales tax required is calculated at checkout. We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, PayPal, and Shop Pay, processed securely by our payment providers. Payment is taken when you place your order.

If we discover a genuine pricing or description error after you order, we’ll contact you to offer the corrected terms or a full refund — we’re not obliged to supply at an incorrect price.

4. Promotions and discount codes

Discount codes and promotions are subject to their own terms, can’t be combined unless stated, have no cash value, apply while stocks last, and may be withdrawn at any time. One code per order unless we say otherwise.

5. Shipping, delivery and returns

Delivery timeframes and costs are set out in our Shipping Policy. Returns and refunds are governed by our Returns & Refunds Policy — in short, 30 days from delivery, unworn with tags. Both policies form part of these Terms.

6. Faulty or incorrect items

If your order arrives faulty, damaged, or incorrect, email us within 14 days with a photo. You’re entitled to a replacement or a full refund (including original shipping), at your choice, with return shipping at our cost. This does not affect your statutory rights.

7. Product descriptions and availability

We take care to describe and photograph products accurately, but colours can vary slightly between screens and minor variations are normal for textiles. Products are subject to availability and we may change or discontinue items at any time.

8. Intellectual property

All content on the site — text, images, logos, product designs, and the site design itself — is owned by or licensed to Marcos Jacob and protected by law. You may not copy, reproduce, or use it commercially without our written permission.

9. Acceptable use

You agree not to use the site for any unlawful purpose, to interfere with its security or operation, to introduce malicious code, or to scrape, harvest, or collect data from it at scale. We may suspend access if you breach these Terms.

10. Feedback

If you send us ideas or feedback, you grant us a free, non-exclusive right to use them to improve our products and store, with no obligation to you.

11. Third-party links

The site may link to third-party sites we don’t control. We’re not responsible for their content, products, or practices, and including a link isn’t an endorsement.

12. Disclaimers

The site is provided “as is” and “as available”. To the extent permitted by law, we don’t warrant that it will be uninterrupted or error-free. Nothing here excludes warranties or rights that can’t be excluded under applicable law.

13. Limitation of liability

To the extent permitted by law, our total liability in connection with any order is limited to the price you paid for it. We’re not liable for indirect or consequential losses. Nothing in these Terms excludes or limits liability that cannot be excluded by law — including for death or personal injury caused by negligence, for fraud, or for your non-waivable statutory consumer rights.

14. Indemnity

You agree to cover reasonable losses we incur from your breach of these Terms or your misuse of the site, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. The version posted here at the time you place an order applies to that order. Continued use of the site after changes means you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a right isn’t a waiver of it. These Terms, with the policies they reference, are the entire agreement between us about your use of the site and your orders. Neither party is liable for delays caused by events beyond its reasonable control.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, and disputes are subject to the non-exclusive jurisdiction of the courts of New York — without removing any right you have to bring a claim under the consumer law of your home state.

18. Your consumer rights

These Terms do not remove the consumer protection rights you have under the law of the US state where you live. You keep all such rights regardless of anything stated here.
